PERADILAN AGAMA YANG BERKOMPETENSI ABSOLUT DALAM PERKARA EKONOMI SYARIAH: TANTANGAN DAN PELUANG INDUSTRI 4.0

Abstract

In the development of recent years, the development of sharia economics in Indonesia has shown significant growth, creating a need for legal certainty in all activities related to sharia-based economic activities. Religious courts, which have been known to focus on personal and family issues, are now faced with the challenge of expanding their absolute competence in resolving sharia economic cases. The method used is a literature study with descriptive qualitative analysis, which examines various legal sources, regulatory documents, and relevant previous research. The results of the study show that since the enactment of Law Number 3 of 2006 which revised Law Number 7 of 1989 concerning Religious Courts, religious courts now not only handle cases of marriage, inheritance, grants, waqf, zakat, infak, and shadaqah, but also have the authority to resolve sharia economic disputes. With this expansion of absolute competence, religious courts are expected to provide legal certainty and protection for business actors and the community who use the sharia economic system, in addition to being able to increase the effectiveness of sharia-based dispute resolution. And the challenges in the industrial era 4.0 increasingly make religious courts have to develop in providing absolute legal certainty for industry 4.0 actors. Under clear laws, religious courts can create legal certainty and protection for industry 4.0 actors who are most comfortable and safe in making transactions.
